What do each of those Courts Do?

The Supreme Court,

Superior Court,

and Commonwealth Court

are all appellate courts whose jurisdiction includes

the entire state of Pennsylvanian.

 

PA Supreme Court – consists of 7-members (judges) and is the highest court in the state, and it handles matters like requests for appeals from the Commonwealth and Superior courts, appeals of lower court decisions involving the death penalty, and requests to intervene in cases that are currently in lower courts.

 

PA Superior Court – has 15-members.  It handles appeals for criminal and most civil cases heard in the Courts of Common Pleas. ALSO, maters matters involving children and families.

 

PA Commonwealth Court – is a 9-member court and handles government-related legal proceedings such as appeals of government agency decisions and trials in cases where the Commonwealth of Pennsylvania is either the plaintiff or defendant.

 

Berks County Common Pleas Courts – They handle mostly felony criminal cases, civil cases with contested amounts over $12k, divorces, custody issues, domestic violence cases, adoptions, estate proceedings, and, family, and orphans.

 

Municipal Courts – Handle criminal arrests trying criminal cases with max sentences of five years, landlord-tenant cases, traffic law violations,small claims cases.

Only GOD is Trustworthy 

ass long   What are the qualities when reviewing an applicant for judge or when electing a judge that should be required?

Judicial Temperament: Can this judge use facts while applying the law to understand how their decision will affect the citizen appearing before the court?

Intelligence: This is the ability to know and apply legal rules, analyses, and procedures to the presented circumstances, and the then understand as well as comprehend new concepts and ideas. They must keep abreast of all aspects new or old around them.

Ethics: Judges have their rules on ethics, but their ethics must be genuine and have morals in both their personal and professional activities.

Courage and Integrity:  Legal “Courage” is “the willingness to do what the law requires the judge to do”. They are not to make new law based upon their ideals or politics. Their ruling may go against their own feelings and beliefs. and may not be the popular one but must be of the written law.

Experience and Education: Knowing where they obtained their education should be of no consequence as long as it was an accredited college of law. But having experience whether personal or professional is of upmost importance.  It does not matter if they have five degrees in law or one. But they must have the experience necessary to be able to understand the written law and then be able to apply the law as written

Suitability for Workload: A judge must be able to demonstrate their ability to manage the intense workload of our courts.  Those who want to serve on an appellate court must enjoy writing, writing opinions, otherwise they need not apply.

Continuing Legal Education: A judicial candidate’s history of attendance at continuing legal education programs should is a good indicator of a person’s interest in remaining current in the law.

Ability to Communicate: The judge must have the ability to communicate both orally and in writing clearly, concisely, and grammatically, so that the common citizen clearly understands. For a citizen to fully understand a judge the judge may be required to use different words or ways.

Health: A candidate in Pennsylvania may not serve over certain age limits. They cannot have any health situations or be taking any medication that could interfere with their high intense job, long hours. The health of an applicant for judge must be considered that might quickly change when electing a judge.

Character: This might be the most important and should be at the top of this list. These following traits must be part of judge’s character, such as good character: courtesy, compassion, courageousness, deference, dignity, encouraging, fairness, forgiveness, honesty,integrity, kindness, loyalty, perseverance, reliability, are but a few that a judge should have.
